U.S. temporary work visas at a glance
U.S. temporary work visas allow eligible foreign nationals to work in the United States for a limited period under a specific employment-based classification. Common categories include H, L, O and P visas, each with its own eligibility rules and employment purpose.
Most petition-based temporary workers must first have an approved petition filed by a qualifying U.S. employer, agent or petitioner. After the required USCIS stage, the applicant generally completes the nonimmigrant visa process and attends a visa interview when required.
Different jobs require different visa classifications
Many temporary employment visa categories are petition-based. The U.S. employer, agent or qualifying petitioner may need to complete a USCIS petition process before the applicant applies for the visa.
H Visas
Temporary worker categories that can include specialty occupations and other qualifying employment classifications.
L Visas
Certain qualifying intracompany transfers involving related business entities and eligible employees.
O Visas
For certain individuals who qualify under extraordinary ability or achievement standards.
P Visas
Certain athletes, entertainers, artists and related support personnel may use P classifications.
Many work visas begin with USCIS
- A qualifying petitioner may file Form I-129 with USCIS.
- The petition must correspond to the correct worker classification.
- After the required petition stage, the applicant may proceed to visa processing when applicable.
- The visa interview should remain consistent with the petition and employment documents.
